210: Timber Harvesting and Transport

Overview

The cutting, gathering, and/or collecting of timber within forest lands, alienable and disposable public lands, and private lands shall require a permit from the Department of Environment and Natural Resources.

     – Special Tree Cutting and/or Earth-balling Permit (STC/EP)

Application Requirements [18]1. Naturally Grown Tree/s within Private Lands

  • Letter of Application Authenticated copy of land title/CLOA issued by the Land Registration Authority or Registry of Deeds, whichever is applicable

  • Utilization Plan, if application covers ten (10) hectares or larger with at least 50% of the area covered with forest trees

  • Report duly signed by the forest officers who conducted the timber inventory of trees to be cut, to include result of the 100% timber inventory i.e. Tally Sheets and Stand and Stock Table of trees to be affected

  • LGU Endorsement interposing no objection to the cutting of trees under the following conditions:
    • If the trees to be cut falls within one barangay, an endorsement from the Barangay Captain shall be secured
    • If the trees to be cut falls within one more barangay, endorsement shall be secured either from the Municipal/City Mayor or all the Barangay Captains concerned; and
    • If the trees to be cut fall within more than one municipality/city, endorsement shall be secured either from the Provincial Governor or all the Municipal/City Mayors concerned.

  • Endorsement from the Local Agrarian Reform officer for areas covered by CLOA

  • Copy of Environmental Compliance Certificate (ECC)/Certificate of Non-Coverage (CNC), if applicable. The DENR RO/EMB shall determine if the tree cutting activities will require ECC/CNC based on the extent of tree cutting operations, location (e.g., Environmentally Critical Area), among others.

2. Naturally Grown Tree/s within Public or Forest Lands

  • Letter of Application

  • Report duly signed by the forest officers who conducted the timber inventory of trees to be cut, to include result of the 100% timber inventory i.e., Tally Sheets and Stand and Stock Table of trees to be affected

  • LGU Endorsement interposing no objection to the cutting of trees under the following conditions:
    • If the trees to be cut falls within one barangay, an endorsement from the Barangay Captain shall be secured
    • If the trees to be cut falls within one more barangay, endorsement shall be secured either from the Municipal/City Mayor or all the Barangay Captains concerned; and
    • If the trees to be cut fall within more than one municipality/city, endorsement shall be secured either from the Provincial Governor or all the Municipal/City Mayors concerned.

  • Copy of Environmental Compliance Certificate (ECC)/Certificate of Non-Coverage (CNC);

  • Copy of approved land tenure instrument/management agreement (e.g., CBFMA / IFMA / SLUP / FLAG / FLAGT / CADT / MPSA / FTAA) together with its approved development/management plan (IOP / CRMF / FYWP / FYIOP / CDMP / ADSDPP / EPEP, etc.)
Tree Inventory Requirement [18]
  • For Private titled land – 100% timber inventory

  • For Forest land covered by approved land tenure instrument/management agreement (i.e. SLUP / FLSG / FLAGT / CADT /MPSA / FTAA) – 100% timber inventory

  • For Forest land Covered by approved land tenure (i.e. IFMA and CBFMA) 20% timber inventory
Transport Procedure [12]Transport Document: Certificate of Timber Origin/ Certificate of Lumber Origin (CTO)/CLO)

  • Transporting logs/ timber/ flitches/ lumber is automatically coordinated by the origin CENRO/ Implementing PENRO to the destination CENRO/ Implementing PENRO, which is inherent to the nature of the issued applicable permits (Tree Cutting, Lumber Dealer, Wood Processing, etc.) through the fastest possible means available, i.e., phone call, email, or fax, while also notifying the DENR Regional Office concerned of the shipment.

  • The DENR Regional Office concerned shall then encode the details of shipment into the CTO and CLO system in six (6) sets, which includes among others, kind and serial number of CTO and CLO issued to a particular client, date of issuance and validity period, date of loading, point of loading, type and plate number of conveyances, name and address of client to whom the forms are issued, name and address of the final consignee, final point of loading, route, volume, and species.

  • No Tree Plantation Registration required. However, all plantation activities, including harvesting of planted trees, should be in accordance with the approved management plan
  • 5% inventory conducted by licensed Forester/s
  • Inventory report submitted to the CENRO/Implementing PENRO

For Private Tree Plantation Owners
  • Register the Private Tree Plantation to the nearest CENRO/Implementing PENRO by submitting the following documentary requirements:
    • Certified True Copy of Original Certificate of Title (OCT) /Transfer Certificate of Title (TCT)/Tax Declaration
    • GIS generated map of tree plantation

Removal and Relocation Requirements [14] [15]
  1. Final and Approved Infrastructure Development Plan with tree charting (e.g., Road Alignment Plan, Building Plan, Detailed Engineering Design or similar plan) indicating the geotagged location of individual trees affected by the project, to be numbered sequentially.

  2. Appropriate Environmental Clearance (CNC/ECC)

  3. LGU endorsement

  4. The application for Tree Cutting and/or earth-balling permits may be processed and issued even without an approved tenure instrument

  5. Certified True Copy of Clearance/Resolution from PAMB. The PAMB Clearance shall include an endorsement for the EMB Regional Office to determine whether the development project or activity is eligible for a Certificate of Non Coverage CNC) or should undergo the scoping process under the EIS System. A development project or activity determined by the scoping process to be environmentally critical shall undertake a full-blown EIA. A
    project or activity that is found to be environmentally critical will undertake IEE instead of EIA. In both cases, and ECC shall be required prior to the commencement of the project or activity.

  6. Clearance from the Palawan Council for Sustainable Development (PCSD), and the Philippine Coconut Authority (PCA) among others as may be applicable.

  7. In case of tree cutting within private lands, Waiver/Consent corresponding to appropriate infrastructure plan.

  2. Certificate from the Secretary, Department of Agriculture or his duly authorized representative that the edible fruit-bearing trees(s) applied for may be cut

Conditions Allowed [23   Cutting of Trees
  1. Any over-mature, diseased or defective tree posing hazards to lives and properties.
  2. Any tree or other vegetation in public and private places that shall be unavoidably affected by infrastructure projects such as construction or widening of roads and bridges, port areas, building construction.
  3. Any tree and other vegetation may be allowed to be cut if earth-balling of such tree and other vegetation is impractical as determined by the DENR.
  4. Cutting in steep areas may be allowed provided that there is an approved development project in the area pursuant to existing ECC guidelines.

Earth-balling of Trees
  1. Only healthy trees or other vegetation shall be earth-balled and transplanted.
  2. The immediate environment or surrounding of the affected tree or vegetation is free from any structures or impediments to support digging and moving operations.
  3. There shall be a suitable and available site for the transplanting of earth-balled trees or other vegetations to guarantee its continuous growth and/or survival

  • In areas covered by the logging ban/ moratorium, no round log or lumber shall be transported outside the province where the PLTP/SPLTP is located unless authorized by the DENR Secretary
